2. Entry is open to all Australian residents aged 18 years and over. Immediate family members of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. Promotion commences 6.00am AEST on 13 June 2011 and ends at 11.59pm AEST on 2 September 2011 (“Promotional Period”).
4. To enter, Eligible Entrants must, during the Promotional Period and in 100 words or less, nominate a female aged 18 years and over who makes a positive contribution to Australian Football and would deserve to attend the 2011 Brownlow Medal presentation dinner. Eligible Entrants may nominate themselves provided they are a female Australian resident aged 18 years and over. Entries must be submitted online via www.afl.com.au/sunrise (“Website”).
5. Incomplete, illegible or incorrect entries, or which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, will be deemed invalid.
6. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
7. The Promoter reserves the right, at any time during, or after the closing date of the promotion, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. One (1) entry permitted per person.
9. Entries are deemed to be received at the time of receipt into the Promotion database and NOT at the time of transmission by the Eligible Entrant. Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.
10. A panel of judges will be selected by the Promoter to determine four (4) winners who they deem, in their absolute discretion, that the prize should be awarded to. The winning nominees will be contacted on or before 11 September 2011 via the telephone number and email address that was submitted to the Website at the same time as the winning entry.
11. The Promoter’s decision is final and no correspondence will be entered into.
12. Each winner will receive:
(a) One (1) ticket to the 2011 Brownlow Medal presentation dinner to be held on Monday 26 September 2011;
(b) Return economy flights from the winner’s nearest capital city, if the winner resides outside Victoria;
(c) Two (2) nights accommodation at a 4 star hotel, to be selected by the Promoter;
(d) Transfers to and from the airport and the Brownlow Medal presentation dinner;
The winners will be responsible for all other expenses including but not limited to meals, spending money and tips and incidentals, if applicable.
13. All nominees must ensure they are available to attend the 2011 Brownlow Medal presentation dinner in Melbourne on Monday 26 September 2011
14. The Promoter will use its best endeavours to contact the winners via the contact information provided at the time the winning entry was submitted, however should the Promoter be unable to successfully contact a winner by Thursday 23 September 2011, the prize will be forfeited
15. If for any reason a winner does not take the prize or any part of the prize at the time stipulated by the Promoter, then the prize or that part of the prize cannot be transferred, exchanged or redeemed for cash
16. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash
17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate
18. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority
19. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the AFL (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion
20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) if the event is cancelled or rescheduled due to any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of the prize, including any personal injury, damage or loss sustained whilst using the prize.
21. Eligible Entrants must ensure that all care is taken when sending messages for this promotion. The Promoter will not be liable for costs incurred, responses received or any other consequences of user error.
22. The Promoter reserves the right, in its absolute discretion, to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
23. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
24. Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media, including appearing on Sunrise if required, for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25. All entries remain the property of the Promoter. The Promoter collects Eligible Entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the Eligible Entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each Eligible Entrant also agrees that the Promoter, the Promoter's employees, related companies and agents, including but not limited to the AFL, may use this information, in any media for future promotional, marketing, publicity, research and profiling purposes without any further reference, payment or other compensation to the Eligible Entrant, including sending the Eligible Entrant electronic messages and telephoning the Eligible Entrant.
26. As a condition of accepting a prize, the winner must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
