2. Entry is open to all Australian residents aged 18 years and over. Immediate family members of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. Promotion commences 7 September 2011 and ends at 6.00pm AEST on 27 September 2011 (“Promotional Period”).
4. To enter, Eligible Entrants must, during the Promotional Period, do the following:
(a) Purchase any product from the Coles Grill range, Coles brand sausages or Coles brand burgers from the meat department at any Coles Supermarket (excluding Coles Express), Bilo Supermarket, Coles Central, Coles Online or Pick n Pay Hypermarket; AND
(b) Register the details of their 2011 Toyota AFL Grand Final BBQ on the promotional web page at www.afl.com.au (“Website”) and, in 25 words or less, state why their 2011 Toyota AFL Grand Final BBQ needs an overhaul.
5. Eligible Entrants must retain a copy of their receipt as proof of purchase to claim their prize in the event they are a winner.
6. Incomplete, illegible or incorrect entries, or which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, will be deemed invalid.
7. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
8. The Promoter reserves the right, at any time during, or after the closing date of the promotion, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. One (1) entry permitted per product purchased.
10. Entries are deemed to be received at the time of receipt into the Promotion database and NOT at the time of transmission by the Eligible Entrant. Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.
11. A panel of judges will be selected by the Promoter to determine the Major Prize winner who they deem, in their absolute discretion, to be the most persuasive. The Major Prize winner will be announced on 28 September 2011 via the Website. The Major Prize winner will also be contacted by the telephone number and email address that was submitted to the Website at the same time as the winning entry.
12. The panel of judges will also determine 50 Minor Prize winners based on the same criteria as the Major Prize winner. The Minor Prize winners will be announced on 5 October 2011 via the Website. The Minor Prize winners will also be contacted by the email address that was submitted to the Website at the same time as the winning entry.
13. The Promoter’s decision is final and no correspondence will be entered into.
14. The Major Prize winner will receive:
(a) Catering at their 2011 Toyota AFL Grand Final day BBQ, including food, alcoholic and non-alcoholic beverages, with quantity and brands to be determined by the Promoter in its absolute discretion;
(b) One (1) new Panasonic 50inch 3D Plasma TV (model number - TH-P50ST30A);
(c) One (1) new BBQ to the value of $1,000, with the Promoter to determine the brand and model in its absolute discretion; and
(d) The attendance of a current or past AFL footballer at the Major Prize winner’s 2011 Toyota AFL Grand Final day BBQ for up to 1 hour prior to the match, with the footballer to be selected by the Promoter in its absolute discretion.
15. Eligible Entrants must ensure that they are available to take the Major Prize on Saturday 1 October 2011 in the event they are the Major Prize winner.
16. The Promoter will use its best endeavours to contact the Major Prize winner via the contact information provided at the time the winning entry was submitted, however should the Promoter be unable to successfully contact the Major Prize winner by Friday 30 September 2011, the attendance of the footballer and the catering will be forfeited.
17. The Minor Prize winners will each receive a $100 Coles gift card.
18. The Promoter will use its best endeavours to contact the prize winners via the contact information provided at the same time as the winning entry was submitted, however should the Promoter be unable to successfully contact a prize winner by 1 December 2011, their prize will be forfeited.
19. Prizes may be subject to additional terms and conditions which individual prize suppliers have put in place.
20. Subject to any unclaimed prizes clause, if for any reason a winner does not take the prize or any part of the prize at the time stipulated by the Promoter, then the prize or that part of the prize cannot be transferred, exchanged or redeemed for cash.
21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate
23. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority
24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the AFL (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion
25. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) if the event is cancelled or rescheduled due to any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of the prize, including any personal injury, damage or loss sustained whilst using the prize.
26. Eligible Entrants must ensure that all care is taken when sending messages for this promotion. The Promoter will not be liable for costs incurred, responses received or any other consequences of user error.
27. The Promoter reserves the right, in its absolute discretion, to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
28. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
29. Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
30. All entries remain the property of the Promoter. The Promoter collects Eligible Entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the Eligible Entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each Eligible Entrant also agrees that the Promoter, the Promoter's employees, related companies and agents, including but not limited to the AFL, may use this information, in any media for future promotional, marketing, publicity, research and profiling purposes without any further reference, payment or other compensation to the Eligible Entrant, including sending the Eligible Entrant electronic messages and telephoning the Eligible Entrant.
31. As a condition of accepting a prize, the winner must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
32. Once prizes have left the Promoter’s premises, the Promoter and their associated agencies take no responsibility for prizes damaged, delayed or lost in transit.
