TERMS AND CONDITIONS

1.    Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.    Entry is only open to Australian residents who enter the competition ‘Pick who you think will make the 2009 Under 18 All-Australian Team’ and register their details when completing their team at afl.com.au/u18s. Each eligible entrant will receive an entry automatically when he/she completes the online registration form.

3.    Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.  Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4.    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5.    Incomplete, indecipherable or illegible entries will be deemed invalid.

6.    Only one entry permitted per person.

7.    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

8.    Promotion commences 12/06/09. Final entries close at 10pm AEST on 01/07/09. The winner will be determined by comparing the official Under 18 All-Australian Committee’s selection with the fan’s competition entry form. The first fan to select all 22 players compared with the Under 18 All-Australian Committee will be awarded the winner. In the event that no-one selects all 22 players correctly, the highest number of correct entries will be awarded the winner. In the event there are fans with the same number of correct players selected, the winner will be determined by the date and time the entry form is received.

9.    The Promoter’s decision is final and no correspondence will be entered into.

10.    The prize is $1,000 NAB Classic Banking account. The total prize pool is $1,000. The winner will be required to open a NAB Classic Banking account. Standard account opening procedures apply and operation of the NAB Classic Banking account is subject to the standard terms and conditions applying to that account, which are available from any NAB branch. Prize money will be deposited into the account 5 days after opening.

11.    If a winner already has a NAB Classic Banking account, prize money will be deposited into that account no later than 5 business days after the winner is notified.

12.    The winner will also be a VIP guest at the 2009 NAB AFL Draft in Melbourne on 28 November 2009. The VIP guest will attend a briefing session prior to the NAB AFL Draft led by Jason McCartney with the top draft prospects. The prize does not include airfares from the winner’s hometown or city and does not include accommodation. If the winner is a minor, the winner must be accompanied by a parent or guardian.

13.    The date and location of the 2009 NAB AFL Draft is subject to change without notice.

14.    If the Prize is not claimed by 5pm AEST 15/7/2009, the winner will forfeit the Prize and the Prize will be awarded to the next valid entry.

15.    Spending money, meals, taxes, insurance, transport to and from departure point, transfers, items of a personal nature, and all other ancillary costs are not included.

16.    In order to be eligible to take the prize, the entrant must be able to take it at the specified time. The entrant specified on the first valid and correct entry will be deemed a “Provisional Winner”. The Provisional Winner will be notified by phone and electronic mail. The following process will apply to the awarding of the prize.

(A)    The Promoter will attempt to contact the Provisional Winner by phone on up to 5 occasions and in writing. He/she has until 5pm AEST on 15/07/09 to claim the Prize. If he/she is contacted prior to 15/07/09 and is eligible he/she will receive the Prize. Otherwise, part (B) will apply.

(B)    Should the Promoter not be able to contact the Provisional Winner, it will attempt to contact the person deemed to have the next valid and correct entry by phone on up to 5 occasions within a 7 day period and in writing, with such process taking place until until such time as the prize is accepted by an entrant.

17.    Subject to the terms and conditions of the participating prize providers, if for any reason a winner does not take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.

18.    If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

19.    The prize, or any unused portion of the prize, is not transferable or exchangeable.

20.    Entrants and their parents/guardians consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

21.    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

22.    Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions.

23.    The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
